IMPORTANT CHANGES TO UK TRADE MARK EXAMINATION SYSTEM
In October 2007 the UK Intellectual Property Office (UKIPO) has adopted the “Search-and-Notify” system and it no longer objects to new trade mark applications on the grounds of pre-existing conflicting registration. It simply examines whether or not a trade mark is distinctive enough to qualify for registration and informs the Applicant and the owners of earlier conflicting UK trade marks only if, and when, the application proceeds to publication.
