Changes to the grievance, dismissal and dispute resolution procedures
From 6 April 2009, the statutory grievance, dismissal and disciplinary procedures were replaced by a more flexible regime. Under the new system, the mandatory "three-step" processes for disciplinary and dismissal procedures undertaken by an employer and for grievances raised by an employee is now abolished. Instead, a revised statutory ACAS Code of Practice sets out the principles of what an employer and employee should do to achieve a reasonable standard of behaviour. An unreasonable failure by an employer to follow the Code will result in a tribunal. The tribunal will have the power to increase any award due by up to 25% for unreasonable behaviour by the employer.
The new Act follows the dispute resolution provisions contained in the Employment Act 2008 and replaces the Employment Act 2002 (Dispute Resolution) Regulations 2004.
